About These Terms and Conditions

1.1      These terms of sale (the “Terms”) apply to all products and consumer licenses of Line 6 software from the Line 6 shop.Line6.com webstore (the “Web Store”).  Please read them carefully as they contain important information about your rights and obligations as well as limitations and exclusions that apply to you.

1.2      These Terms, together with the Privacy Policy (https://Line6.com/privacypolicy.html) and Website Terms of Use (https://Line6.com/termsofuse.html), tell you information about the legal terms and conditions under which Line 6 makes Software available for license to end-users from the Web Store.  Your use of the Web Store is governed by these policies.

1.3      If you have licensed Software from a third-party retailer or reseller, these Terms do not apply to you and you should refer to the terms and conditions of sale of the relevant retailer or reseller.

1.4      You must be 18 years of age or older to license Software from this Web Store.

1.5      You agree that these Terms apply to your license of the Software. If you refuse to accept these Terms, do not order Software from the Web Store. We recommend that you print a copy of these Terms or save a copy to your computer for future reference after placing an order.

Definitions

2.1      "Hardware" means a physical Product (including boxed software) that is delivered to you by Line 6 or our fulfillment partners to your physical shipping address.

2.2      "Line 6" refers to Line 6, Inc. a California corporation located at 25680 Agoura Road, Calabasas, California 91302.

2.3      "License Manager" means Line 6’s free software utility that enables the delivery and functionality of your Line 6 License Order.

2.4      "Line 6 License Order" means the license and delivery of one or more Software products in a single transaction delivered by internet download to your computer that requires activation using the Line 6 License Manager.

2.5      "iLok License Order" means the license and delivery of one or more Software products in a single transaction delivered by internet download that requires the deposit of an iLok License into an iLok hardware device to authenticate the software.

2.6      "Limited Warranty" means a downloadable software-only product that is licensed to you subject to the applicable end-user license agreement, delivered to your computer via the internet, and described in your order confirmation and receipt (each delivered by email to the email address provided by you to Line 6).

2.7      "Products" means products that is purchase from Line6.com which is not Software.

2.8      "Receipt" means the email confirmation sent to you confirming our acceptance of your order and dispatch of the Software.

2.9      "Software" means a downloadable software-only product that is licensed to you subject to the applicable end-user license agreement, delivered to your computer via the internet, and described in your order confirmation and receipt (each delivered by email to the email address provided by you to Line 6).

2.10      "Website" means the website operated by Line 6 and located at the URL: www.line6.com.

2.8      "Web Store" means the online store operated by Line 6 located at the URL: shop.Line6.com.

 

 

Order Process

3.1           Hardware. Upon placing an order for Hardware, you will receive (A) an onscreen confirmation, which we suggest you print for your records, and (B) an e-mail confirmation from Line 6 acknowledging the order. Upon shipment of the order, you will receive a Purchase Receipt via e-mail that will include your order number, ship date, ship-to address and tracking number.

3.2           Software. Upon placing an order for Software (whether a Line 6 License Order or an iLok License Order), you will receive (A) an onscreen confirmation, which we suggest you print for your records, and (B) a Receipt via e-mail acknowledging the order and providing activation instructions.

3.3           In ordering products through the Website, by telephone, or otherwise, you agree to provide only true, accurate, current, and complete payment information. By placing an order, you represent and warrant that you will only provide payment information which is yours or for which you are authorized to provide. Line 6 shall have the right to cancel your order or to suspend or terminate your account if we have grounds to believe that you have provided inaccurate, not current, fraudulent, or incomplete payment information to Line 6, or for any other reason that we, in our sole discretion, deem appropriate. You agree that your placement of an electronic order on the Website is sufficient to satisfy any applicable Statute of Frauds, and no further writing is required.

3.4           Line 6 reserves the right without prior notice to discontinue products, models, parts and accessories, and other items or change specifications at any time without notice or liability to any third party.

 

 

Prices

4.1      Prices offered on the Web Store are in U.S. dollars. Foreign currency may be displayed for informational purposes only. The price paid as reflected on your Receipt is in U.S. dollars.

4.2      Prices do not include sales tax, if applicable, which will be added to your total invoice price and provided to you both before you place your order and in your order confirmation. You are responsible for any federal, state and local taxes that may apply to your order.

4.3      Prices do not include shipping and handling, expedited service, or sales tax if applicable, which will be added to your total invoice price and provided to you both before you place your order and in your order confirmation. You are responsible for any shipping and handling charges and state and local sales and use taxes that may apply to your order.

4.4      Prices and configurations advertised on the Web Store are subject to change without notice or obligation prior to acceptance of your order. Please be aware that prices, availability and other purchase terms are subject to change without prior notice. We make every effort to ensure the accuracy of the information on the Website and to correct errors once discovered. Line 6 reserves the right to revoke any stated offer to correct any errors, inaccuracies, or omissions, including after an order has been submitted, after it has been confirmed, or after your credit card has been charged. If we discover an error has occurred after your credit card has been charged and your order is canceled as a result of the error, your credit card will be refunded the full amount of your order.

4.5      The final, total price, including any applicable taxes, will be stated on your Receipt.

4.6      If you order a product, payment must be received by Line 6 prior to Line 6’s acceptance of the order. Line 6 may require additional information regarding your order if you have not provided all of the information required, and may cancel or limit an order any time after it has been placed. Your order is expressly conditioned on acceptance of this Agreement. Once a properly completed order, your authorization and a form of payment has been received, we will promptly locate the item(s) you have ordered to place them in line for shipment. All items are subject to availability. We will promptly inform you if the product(s) you have ordered are not available and we may offer you alternative product(s) of equal quality and value. Line 6 does not accept orders from dealers, wholesalers, or customers who intend to resell items offered on the Website. If Line 6 discovers that you are placing orders with the intent to resell items offered on the Website, we will immediately cancel your order, suspend or terminate your account, and pursue any and all available legal remedies from you under applicable law. To the extent your conduct may be fraudulent, such as purchasing products using fake or stolen cards, Line 6 will also report you to federal, state and/or local enforcements authorities.

 

 

Delivery

5.1      Hardware

5.1.1      Line 6 will deliver all Hardware Products to the delivery address stated on your order. Delivery will be completed when the Hardware is transferred to the carrier (UPS, Federal Express, DHL, etc.) for shipment to the address you provided to us. The Hardware will be your responsibility from the completion of delivery to by the carrier and you will own the Hardware once we have received payment in full, including all applicable delivery charges.

5.1.2      The cost of shipping and handling will be shown on your Purchase Receipt. Line 6 will inform you of estimated shipment dates, but it will not be responsible for delays in delivery due to events beyond its control, including shortage of materials, labor strikes, transportation failures, or acts of god.

5.1.3      You must examine the Hardware upon receipt. If any item is damaged or missing, you must notify Line 6 within ten days from the date of delivery.

5.1.4      Line 6 will not deliver Hardware outside of the United States.

5.2      Software

5.2.1      Licenses and delivery of Software can be completed using the Line 6 License Order or iLok License Order.

5.2.2      Line 6 License Orders are delivered by internet download to your computer, and require activation of the Software using only Line 6’s License Manager utility tool.  You will receive one (1) license per order that can be managed in your Line 6 user account’s "Purchase History" page.

5.2.3      iLok License Orders are delivered by internet download into an iLok hardware device via your computer.  To facilitate delivery, the iLok License is delivered to your Line 6 user account.  From your Line 6 user account you can download the iLok License into an iLok hardware device using your computer.  You will receive one (1) iLok Deposit License per Software product purchased.  You can activate and manage your iLok licenses on the iLok Deposits page (https://www.ilok.com/#!home).

 

 

Payment

6.1      You can pay for Software licenses using a debit card, credit card or gift cards featuring the Visa®, Master Card® or American Express® logos.  You can also pay for Products using PayPal.  For help setting up or accessing your PayPal account, contact PayPal.  Checks are not accepted.

6.2      We will not charge your card or account until the Software is available for download.

 

 

Return Policy

7.1      Hardware

7.1.1      You may return most new, boxed and unopened Hardware Products within fifteen (15) days of your purchase thereof, except electronic parts that have been installed, opened software, and iLok Licenses cannot be returned.

7.1.2      Shipping and Handling charges are not refundable.

7.1.3      You are responsible for the Products until they are received by Line 6.

7.1.4      You will be charged shipping and handling or a twenty percent (20%) restocking fee for all returned Hardware Products.

7.1.5      All returned Products must be in the same condition as you received them. THIS RETURN POLICY IS NOT A WARRANTY.

7.1.6      Line 6 will not accept the return of any products you purchased from a retailer or reseller.

7.1.7      1.1.1 Return Hardware: To return a new unopened boxed Hardware Product please follow these steps:

7.1.7.1      Call Line 6 Customer Support at 818-575-3600, option 2; OR Visit the Website; click on "Sign In", log into your Line 6 Account; and click on "Open a Support Ticket".

7.1.7.2      Upon creation of your Support Ticket, our customer support staff will contact you via email at the address you provided. Upon determining the reason for the return, faulty or not faulty, a return merchandise authorization (“RMA”) number and a courier return call tag will be created and emailed to you.

7.1.7.3      You must return the Hardware within fifteen (15) days following the date your received your RMA number. Please note: You have a legal obligation to keep the Product(s) in your possession and to take reasonable care while they are in your possession.

7.1.7.4      Upon receipt and inspection of the Hardware Product, Line 6 will refund your original purchase price and related sales taxes, excluding shipping and handling, to the PayPal account, credit or debit card used to pay for the Product.

7.2      Software

7.2.1      We will not accept the return of any Software that you purchased from a third party.

7.3      Line 6 License Order

7.3.1      You may return Line 6 License Orders of Software at any time during the first fifteen (15) days following the date of your license for a full refund subject to the conditions set forth in this Section 8.2.  After this fifteen (15) day period, returns will not be accepted and no refund will be paid.

7.3.2      All Software licensed in a single transaction must be returned together.  A refund for less than the full original order amount cannot be issued.

7.3.3      To return a Line 6 License Order please follow these steps:

7.3.3.1      De-authorize all of your devices using the License Manager utility program.

7.3.3.2      Log into your Line 6 User Account.

7.3.3.3      Go to the ‘Purchase History’ page and click on the ‘Details’ link.  Find the order you want to return and make a note of the order number to be returned.  Open a ticket at www.Line6.com/support/itckets and include the order number to be returned.

7.3.3.4      Re-authorize all of your devices using the License Manager utility program once directed by Line 6 staff. 

7.4      iLok License Order.  We cannot accept returns of any iLok License order because the iLok License is managed by a third party (iLok).

 

 

Limitation of Liability

8.1   These Terms of Sale set out the full extent of our obligations and liabilities in respect of the supply of the Products and Software.

8.2      There are no warranties, conditions or other terms that are binding on Line 6 except as expressly stated.

8.3      The maximum aggregate liability of either party to the other on all claims of any kind under or related to this Agreement, whether in contract, warranty, condition, tort, strict liability, statute, or otherwise, SHALL BE LIMITED TO THE SUM PAID TO LINE 6 FOR THE PRODUCT OR SOFTWARE IN QUESTION. IN NO EVENT SHALL ALL RECOVERIES, WHETHER BASED ON A SINGLE CLAIM OR ON SEVERAL CLAIMS, FIVE THOUSAND DOLLARS ($5,000).

8.4      IN NO EVENT WHETHER AS A RESULT OF BREACH OF CONTRACT, WARRANTY, CONDITION, TORT, STRICT LIABILITY, STATUTE OR OTHERWISE SHALL EITHER PARTY BE LIABLE TO THE OTHER FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES (INCLUDING LOST BUSINESS PROFITS OR REVENUE, LOSS OF CONTRACTS, LOSS OF DATA, INTERRUPTION IN USE, UNAVAILABILITY OF DATA, OR THE COST OF THE PROCUREMENT OF SUBSTITUTE GOODS) OR FOR PUNITIVE OR EXEMPLARY DAMAGES. The limitations shall not apply to (i) any claim by Line 6 against you for violation of intellectual property rights, or (ii) for payment of the amount due to Line 6 by you for Products and Software purchased under the Agreement. THE REMEDIES SET FORTH IN THIS AGREEMENT WILL BE YOUR SOLE AND EXCLUSIVE REMEDIES FOR ANY CLAIM AGAINST LINE 6 UNDER OR RELATED TO THIS AGREEMENT. You waive and relinquishes any right or claim that might arise out of Line 6’s refusal to accept your order.

8.5      Nothing in the Agreement shall limit or exclude Line 6’s liability (i) for death or personal injury caused by Line 6’s negligence, (ii) for fraud, (iii) for any breach of the obligations implied by applicable compulsory national laws or (iv) any liability which cannot be excluded by law. If this Agreement is held to constitute a supply of goods or services to a “consumer” by a competent judge in Customer’s jurisdiction by application of mandatory principles of consumer law in that jurisdiction.

 

 

Data Protection

9.1   By placing an order, you agree and understand that Line 6 may store, process and use data collected from your order for the purposes of processing the order. Line 6 shall protect your information in accordance with the Line 6 Privacy Policy.

 

 

Export Control

10.1   1.1 Customer shall comply with all laws, regulations and orders of the United States, applicable to the export, re-export, transfer or resale of products or the provision of services and related technical data.

 

 

Limited Warranty; Disclaimer of Warranties

11.1      All Software is sold ‘as is’ without warranty of any kind.

11.2      The Warranty for Products is located at http://shop.Line6.com/services/helix-service-plus/.

11.3      Line 6 has no obligation to you with respect to providing any warranty on any Product for which we have not received full payment from you.

11.4      The Limited Warranty, if any, is the only warranty applicable to the Hardware. No oral or written information (including but not limited to the limited money back guarantee), or advice given by Line 6, its agents or employees shall create a warranty or in any way increase the scope of the Limited Warranty.

11.5      The right to return defective Products, as described above, shall constitute Line 6's sole liability and your exclusive remedy in connection with any claim of any kind relating to the quality, condition or performance of any Products, whether such claim is based upon principles of contract, warranty, negligence or other tort, breach of any statutory duty, principles of indemnity or contribution, or otherwise.

Helix Native Promotional Savings

Terms and Conditions

 

Qualified Purchasers can receive Promotional Savings on a Helix Native license when they purchase and register an Eligible Product according to the terms and conditions of this offer.

 

Qualified Purchasers: A “Qualified Purchaser” is an individual who purchases (or has purchased) an Eligible Product from an Authorized Reseller and registers (or has registered) the Eligible Product with Line 6 at www.line6.com/support/account-services.  

  • Registration of the Eligible Product is required for a Qualified Purchaser to demonstrate that he or she qualifies for the Promotional Savings.
  • Public entities, government entities, nonprofit organizations, educational institutions, enterprise purchasers and business purchasers do not qualify and Line 6 reserves the right to cancel purchases made by such purchasers. 

 

Eligible Products:  “Eligible Products” include Helix® Floor, Helix® Rack, Helix® LT, POD® X3 (all models), POD Farm® Platinum, POD Farm® Standard, POD Studio® (all models), Tone Port™ UX8, Tone Port™ Silver bundle, and Tone Port™ Gold bundle only. The following purchase restrictions apply to this Offer:

  • Eligible Products must be purchased as new from an authorized Line 6 reseller (an “Authorized Reseller”). 
  • Purchases of Eligible Products from online auctions are not eligible for this Offer.
  • Eligible Products do not include refurbished products, “b-stock” items, open box items or returns sold “as is”, or other non-new products.

    • If an Eligible Product is sold by the Qualified Purchaser to a third party within one hundred eighty (180) days from the date of purchase from the Authorized Reseller,

Promotional Product Returns: The Promotional Product may be returned to the Authorized Reseller or Line 6, as applicable, for a full refund within thirty (30) days of the date of purchase.

HELIX® Service Plus Warranty Program

Terms and Conditions

The Helix Service Plus Warranty Program Plan (the “Plan”) is governed by these Terms and Conditions and constitutes your contract with Line 6, Inc. (“Line 6”) as described herein and is subject to these Terms and Conditions:

  1. Covered Products

    The Plan applies ONLY to Helix Floor, Helix Rack + Helix Control, and Helix LT products and only where such product(s) are still covered by the original manufacturer limited warranty that accompanied the product at the time of purchase (the “Limited Warranty”, a copy of which is set forth in Exhibit A attached hereto and incorporated herein by this reference) (each a “Covered Product”). The Limited Warranty remains fully applicable except as modified by the terms of this Plan. In the event of a conflict between the Limited Warranty and this Plan, the terms of this Plan shall govern.

  2. Limited Warranty

    The Limited Warranty remains fully applicable except as extended and supplemented by the terms of the Plan. In the event of a conflict between the Limited Warranty and this Plan, the terms of this Plan shall govern.

  3. Territorial Restriction

    The Plan is valid for residents of the United States of America (excluding US territories and possessions) (the “Territory”) and full benefits under the Plan are only extended to products that are physically located within the Territory at the time repair or replacement service is required. The Plan does not cover costs of international shipping, import duties, VAT payments, customs expenses or similar expenses involving shipping a product to or from a location outside of the Territory.

  4. Coverage Options

    The Plan offers a choice of three options:

    1. Advanced Replacement

      Line 6 will ship you a loaner product within one business day (within U.S. only), which you return once you’ve received your repaired Helix—all at no cost to you. Helix Service Plus Advanced Replacement may be purchased at any time during the period covered by the original Limited Warranty or Service Plus Extended Warranties.

    2. Extended Warranty -- Level 1

      • One additional year of warranty coverage
      • 100% parts & labor coverage for materials and workmanship
      • Free UPS Ground shipping to and from Line 6
    3. Extended Warranty -- Level 2

        All Level 1 coverage Plus:
      • Expedited Turnaround Time (your item receives prioritized repair service)
      • Advanced Replacement

    Under Advanced Replacement available in options 1 or 3 above, once service is complete, Line 6 will provide you with a prepaid shipping label to return the loaner unit to Line 6. (Note that you will be required to sign a Product Loan Agreement and follow the terms and conditions thereof for the use, care and return of the loaner unit.)

    Your eligibility for expedited service under Level 2 begins on the date your Covered Product’s original Warranty Period expires and terminates at the end of the Extended Warranty Period purchased by you.

    Both Level 1 and Level 2 extended warranty Plan options (individually or jointly an “Extended Warranty”) extend the Limited Warranty on Covered Products by one-year increments (each increment and any additional increments constitute the “Extended Warranty Period”) up to a maximum of five (5) consecutive years of warranty coverage (the original Limited Warranty plus any Extended Warranty Period) from the original purchase date. You may purchase each additional year of Extended Warranty coverage at any time that an existing Limited Warranty or Extended Warranty is still in effect and up to one (1) month following the expiration of the then-applicable warranty period (i.e., either during the original Limited Warranty period or any Extended Warranty Period, as applicable, subject to the five (5) year maximum specified above).

    Both Extended Warranty Plan options also enable you to transfer these Terms and Conditions of an existing warranty to a replacement product should Line 6 determine that replacement of a Covered Product is appropriate.

    If during this Plan’s extended warranty period there is a defect in the materials or workmanship covered by the original Limited Warranty of the Covered Product, Line 6 will, at its option, repair or replace the affected item. If Line 6 replaces the Covered Product, the replacement product and its serial number will then assume the remaining Coverage Period under the Plan.

    The scope of support provided to you will vary according to the coverage option you purchase.

  5. Limitations, Exclusions, and Restrictions:

    Repair and replacement under Level 1 and Level 2 Extended Warranty coverage does not cover or include: 1. Installation or maintenance of any Covered Product or accessories (including attachments or add-on devices) or troubleshooting any electrical issues external to the Covered Product itself; 2. Damage to the Covered Product caused by accident, abuse, neglect, misuse (including faulty installation, repair, or maintenance by anyone other than Line 6 or a Line 6 Authorized Service Provider), unauthorized modification, extreme environment (including extreme temperature or humidity or exposure-submersion in water), extreme physical or electrical stress or interference, fluctuation or surges of electrical power, lightning, static electricity, fire, acts of God or other external causes; 3. A Covered Product with a serial number that is illegible for any reason or that has been altered, defaced, tampered with, or removed; 4. Problems caused by any device that is not the Covered Product, whether or not such device was purchased at the same time as the Covered Product or is or is not a “Line 6” branded product; 5. Service necessary to comply with the regulations of any government body or agency arising after the date of this Plan; 6. Covered Product that has been lost or stolen; 7. This Plan only covers Covered Product that is returned to Line 6 in its entirety; 8. Cosmetic damage to the Covered Product including but not limited to scratches, dents and broken plastic on ports; 9. Consumable parts, such as batteries; 10. Preventative maintenance on the Covered Product; Your use of modified or modification of Covered Product(s), Line 6 Software and Drivers, Mac OS or iOS in a manner for which the Covered Product(s) or software is not intended to be used or modified; 11. Third-party products or their effects on or interactions with the Covered Product; 12. Damage to, or loss of any software or data recorded by the Covered Product or connected devices; or 13. Issues that could be resolved by upgrading Line 6 software or firmware to the then current version.

  7. Manufacturer Service and Repair:

    You must return your Covered Product to Line 6 for warranty service under this Plan. Line 6’s Authorized Service Centers will provide warranty service during the original Limited Warranty period only. Line 6 may provide replacement product or parts that are new or refurbished by Line 6. All replacement parts and products are equivalent to new in performance, quality and reliability. The replacement product or parts will assume the remaining Coverage Period under the Plan. The products or parts that are replaced become Line 6’s property.
  8. Obtaining Repair Service

    To obtain service, Contact Line 6 technical support via telephone at 818-575-3600, option 2, or via the web at www.line6.com/support/tickets. Line 6’s hours of service are Monday - Friday, 8:00 a.m. - 12:00 p.m. and 1:00 p.m. – 4:00 p.m. Pacific Time. Line 6 reserves the right to change its hours of technical service and telephone numbers at any time. Web-based support resources, including instructions for requesting repair service, are available on the Line 6 website. If calling, please be prepared to provide the Line 6 technical support representative with your purchase transaction number (as stated in your purchase order confirmation email), your username, and the Covered Product’s serial number. Advise your technical support representative as to all problems and they will determine what service, if any, might be necessary for the Covered Product. All service is subject to Line 6’s prior approval. Time of service may vary due to your location. Keep this Plan document and the original sales receipt for your Covered Product. Proof of purchase may be required if there is any question as to your product’s eligibility for Plan coverage. Only our support team can authorize a Covered Product return for service or replacement by issuing a Return Merchandise Authorization (“RMA”) number. Line 6 will ONLY accept for service and provide service to Line 6 products with an RMA number clearly written on the return shipping box. Once you receive an email from Line 6 with RMA instructions, your RMA is complete and ready to be shipped to us. A. Your Responsibilities To receive service under the Plan, you agree to comply with the following: 1. Provide your username and serial number of the Covered Product; 2. Provide information about the symptoms and potential causes of the problems with the Covered Product; 3. Respond to requests for information, including but not limited to the version of the host operating system and software installed, any peripheral devices connected or installed on the Covered Product or host computer, any error messages displayed, actions taken before and after the Covered Product experienced the issue; 4. Follow directions from Line 6 technical support in order to perform diagnostics; 5. If instructed by Line 6 technical support, update product and/or host computer or device firmware and software to currently published releases prior to requesting to return your product for servicing; 6. Follow the instructions Line 6 gives you, including but not limited to, refraining from sending Covered Products and accessories without an RMA number authorized by Line 6 Technical Support; 7. Carefully follow packing and shipping instructions as detailed by Line 6 Technical Support; and 8. Be sure the RMA number is clearly displayed on the outside of the shipping packaging. B. Getting Your Covered Product to Us Under the Plan, you have the option of shipping the product to us at no cost to you or bringing the product to us in person. If you elect the shipping option, we will send you a pre-paid shipping label. You may then ship the Covered Product to Line 6’s repair service location in accordance with its instructions. Once service is complete, the Line 6 repair service location will return the Covered Product to you. If you elect the carry-in option, you may bring the Covered Product, along with a completed RMA (we regret that we cannot accept any Covered product without this) to Line 6, Inc., 26580 Agoura Rd., Calabasas, CA 91302. We will notify you when service is complete so that you may pick up your product. Please Note: Line 6 reserves the right to change the method by which Line 6 may provide repair or replacement service to you including use of Line 6 approved 3rd party repair facilities. Service options, parts availability and response times may vary according to your location and time of shipment.
  9. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LINE 6 AND ITS EMPLOYEES AND AGENTS WILL UNDER NO CIRCUMSTANCES BE LIABLE TO YOU OR ANY SUBSEQUENT OWNER FOR ANY INDIRECT OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO COSTS OF RECOVERING, REPROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA OR THE LOSS OF BUSINESS, PROFITS, REVENUE OR ANTICIPATED SAVINGS, RESULTING FROM LINE 6’S OBLIGATIONS UNDER THIS PLAN. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LIMIT OF LINE 6 AND ITS EMPLOYEES AND AGENTS’ LIABILITY TO YOU AND ANY SUBSEQUENT OWNER ARISING UNDER THE PLAN SHALL NOT EXCEED THE ORIGINAL PRICE PAID FOR THE PLAN. FOR CONSUMERS IN JURISDICTIONS WHO HAVE THE BENEFIT OF CONSUMER PROTECTION LAWS OR REGULATIONS, THE BENEFITS CONFERRED BY THIS PLAN ARE IN ADDITION TO ALL RIGHTS AND REMEDIES PROVIDED UNDER SUCH LAWS AND REGULATIONS. TO THE EXTENT THAT LIABILITY UNDER SUCH LAWS AND REGULATIONS MAY BE LIMITED, LINE 6’S LIABILITY IS LIMITED, AT ITS SOLE OPTION, TO REPLACE OR REPAIR THE COVERED PRODUCT OR SUPPLY THE SERVICE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
  10. Cancellation of Plan

    You may cancel the Plan at any time for any reason. If you decide to cancel, either call Line 6 at the telephone number below, or mail a written notice with your Contract Number to Line 6 Service Plus Program, 26580 Agoura Road, Calabasas, CA 91302. A copy of the Plan’s original proof of purchase must accompany your notice. Unless local law provides otherwise, if you cancel within thirty (30) days of your Plan’s purchase, you will receive a full refund less the value of any service provided under the Plan. If you cancel more than thirty (30) days after your receipt of this Plan, you will receive a pro rata refund of the original purchase price, based on the percentage of unexpired Coverage Period, and (b) less the value of any service provided to you under the Plan. Unless applicable local law provides otherwise, Line 6 may cancel this Plan if service parts for the Covered Product become unavailable, upon thirty (30) days’ prior written notice. If Line 6 cancels this Plan, you will receive a pro rata refund for the Plan’s unexpired term.
  11. One-Time Transfer to Third Party

    Subject to the restrictions set forth below, you as the original purchaser may make a one-time permanent transfer of all rights under the Plan to another party, provided that: 1. The transfer includes the original Proof of Purchase; 2. You notify Line 6 of the transfer of the Plan by telephone or by using our online support system: Telephone: 818-575-3600, option 2 Support Ticket: www.line6.com/support/tickets; 3. The party receiving the Plan reads and agrees to accept the Terms and Conditions of the Plan. When notifying Line 6 of the transfer of the Plan, you must provide your user name, the serial numbers of the Covered Product being transferred and the name, address, telephone number and email address of the new owner; and 4. Only the original purchaser of the plan may make a one-time permanent transfer of all their rights under the Plan to another party.
  12. General Terms

    a. When Line 6 support deems a Covered Product requires service and issues an RMA number, the Plan will cover round trip ground shipping within the Territory only. b. Line 6 may subcontract or assign performance of its obligations to third parties but shall not be relieved of its obligations to you in doing so. c. Line 6 is not responsible for any failures or delays in performing under the Plan that are due to events outside Line 6’s reasonable control. d. You are not required to perform preventative maintenance on the Covered Product to receive service under the Plan. e. This Plan is offered and valid only in the Territory. This Plan is only offered to persons who are 18 years of age or older at the time of purchase. This Plan is not available where prohibited by law. f. You agree that in carrying out its obligations Line 6 may, at its discretion and solely for the purposes of monitoring the quality of Line 6’s response, record part or all of the calls between you and Line 6. g. You agree that any information or data disclosed to Line 6 under this Plan is not confidential or proprietary to you. Furthermore, you agree that Line 6 may collect and process data on your behalf when it provides service. h. In the event Line 6 has access to your data, Line 6 has security measures which should protect your data against unauthorized access or disclosure as well as unlawful destruction. i. The Terms and Conditions of this Plan prevail over any conflicting, additional, or other terms of any purchase order or other document, and constitute your and Line 6’s entire understanding with respect to the Plan. j. Line 6 is not obligated to renew this Plan. If Line 6 does offer a renewal, it will determine the price and terms. k. There is no informal dispute settlement process available under this Plan. l. Except where prohibited by law, the laws of the state of California govern the sale of all Plans. m. There is no deductible payment due in respect of a claim made under this Plan.

Original Limited Warranty

1 YEAR LIMITED WARRANTY POLICY

PLEASE READ THIS DOCUMENT CAREFULLY. IT CONTAINS IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU. BY ACCEPTING DELIVERY OF THE PRODUCTS, YOU AGREE TO BE BOUND BY AND ACCEPT THESE TERMS AND CONDITIONS.

Limited Warranty:

Line 6 warrants that your new Line 6 product, when purchased at an authorized Line 6 retailer located in the Territory, shall be free of defects in materials and workmanship for a period of One (1) Year from the original date of purchase, except that vacuum tubes are warranted for a period of ninety (90) days from the original date of purchase (the “Warranty Period”) or unless local statutory law requires otherwise. Line 6 may, in its sole discretion, require proof of the original purchase date in the form of a dated copy of the original authorized dealer’s invoice or sales receipt.

Covered Territory:

This Limited Warranty only applies to Line 6 products purchased as new from an authorized Line 6 retailer in the United States of America (the “Territory”).

Additional Territory Requirements and Limitations:

Authorized Service Centers outside of the Territory will not service or repair a product purchased outside of the Territory. For example, if you purchased your product in the United States you must return it to an authorized service center located in the United States. Products purchased outside of the Territory are subject to such warranties as may be offered by the importing agent (distributor) in that country, if any, and are not covered by this Limited Warranty.

Other Conditions:

During the Warranty Period: (a) Line 6 shall, in its sole discretion, either repair or replace any product that proves to be defective upon inspection by Line 6; (b) Line 6 reserves the right to update any product returned for repair and to change or improve the design of the product at any time without notice, which may result in a loss of user generated patches and set up information; (c) Line 6 reserves the right to use reconditioned parts and assemblies as warranty replacements for authorized repairs; (d) Service and repairs are to be performed only by Line 6 repair facilities in the United States or a Line 6 authorized service center; (e) Line 6 may require advanced authorization of repairs to authorized service centers. This is your sole warranty. Line 6 does not authorize any third party, including any dealer, retailer or sales representative, to assume any liability on behalf of Line 6 or to make any warranty for Line 6.

Shipping/Freight:

You are responsible for all shipping and freight charges to transport your product to Line 6 or Line 6’s authorized service center. Line 6 will pay for shipping and freight charges, within the Territory of purchase only, to return your product after service is complete.

Transferability/Assignment of Warranty:

This Limited Warranty is extended to the original retail purchaser. This Limited Warranty can be transferred to anyone who may subsequently purchase this product provided that such transfer is made within the Warranty Period and Line 6 is provided with all of the following items: (a) all warranty registration information (as set forth on the registration card) for the new owner, (b) proof of the transfer within thirty (30) days of the transfer purchase, and (c) a photocopy of the original sales receipt. Warranty coverage shall be determined by Line 6 in its sole discretion.

DISCLAIMER AND EXCLUSIONS:

THE FOREGOING WARRANTY IS THE ONLY WARRANTY GIVEN BY LINE 6 AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE, EXCEEDING THE SPECIFIC PROVISIONS OF THIS WARRANTY ARE HEREBY DISCLAIMED AND EXCLUDED FROM THIS WARRANTY. UPON EXPIRATION OF THE APPLICABLE EXPRESS WARRANTY PERIOD DESIGNATED ABOVE, LINE 6 SHALL HAVE NO FURTHER WARRANTY OBLIGATION OF ANY KIND.

Line 6 shall NOT be liable for and this Limited Warranty does not apply to:

  • Products purchased from an un-authorized Line 6 retailers.
  • Claims based on any misrepresentation made by the Seller.
  • Products returned without proof of purchase.
  • Products that have been altered such that the serial number, name, identification numbers or logos have been tampered with or are missing.
  • Products that have been modified from the original design.
  • Damages incurred during transit. You should contact the shipper for proper claims procedures in the event of damage or loss resulting from shipment. When returning products to Line 6 for repair or replacement, you assume all risk of loss or damage until such time as the product is accepted by Line 6 or Line 6’s authorized service center.
  • Damages incurred from un-authorized adjustment, repair or service by anyone other than Line 6 or Line 6’s authorized service centers.
  • Damages caused by accident (such as liquid contamination), misuse, abuse (such as dropping the product), neglect, or improper storage of the product.
  • Damages incurred by fire, flood, earthquake, water, wind, lightning or other natural disaster.
  • Physically damaged connectors.
  • Damage incurred from any use of the product in any application other than the use for which it was intended.
  • Damage incurred from improper installation or the failure to follow any instructions contained in the Pilot’s Guide or product Manual.

LIMITATION OF LIABILITY:

LINE 6 SHALL IN NO EVENT BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES SUFFERED BY THE PURCHASER OR ANY THIRD PARTY, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS OR BUSINESS, OR DAMAGES RESULTING FROM USE OR PERFORMANCE OF THE PRODUCT, WHETHER IN CONTRACT OR IN TORT EVEN IF LINE 6 HAS BEEN ADVISED OF THE POSSIBILITY THEREOF. LINE 6 SHALL NOT BE LIABLE FOR ANY EXPENSES, CLAIMS, OR SUITS ARISING OUT OF OR RELATING TO ANY OF THE FOREGOING. Line 6’s entire liability for any defective product shall in no event exceed the actual purchase price paid for the defective product.

Governing Law:

The interpretation and enforcement of these terms and conditions shall be governed by the laws of the State of California.
