About These Terms and Conditions

1.1      These terms and conditions (the “Terms”) apply to all consumer licenses of Line 6 software from the Line 6 shop.line6.com webstore (the “Web Store”).  Please read them carefully as they contain important information about your rights and obligations as well as limitations and exclusions that apply to you.

1.2      These Terms are only available in English.  Any translations of these Terms that may be available are non-binding and informational only.

1.3      These Terms, together with the Privacy Policy and Website Terms of Use, tell you information about the legal terms and conditions under which Line 6 makes Software available for license to end-users from the Web Store.  Your use of the Web Store is governed by these policies.

1.4      If you have licensed Software from a third party retailer or reseller, these Terms do not apply to you and you should refer to the terms and conditions of sale of the relevant retailer or reseller.

1.5      You must be 18 years of age or older to license Software from this Web Store.

1.6      You agree that these Terms apply to your license of the Software.  If you refuse to accept these Terms, do not order Software from the Web Store.  We recommend that you print a copy of these Terms or save a copy to your computer for future reference after placing an order. 

 

 

Definitions

2.1      Line 6” refers to Line 6, Inc. a California corporation located at 25680 Agoura Road, Calabasas, California 91302.

2.2      License Manager” means Line 6’s free software utility that enables the delivery and functionality of your Line 6 License Order.

2.3      Line 6 License Order” means the license and delivery of one or more Software products in a single transaction delivered by internet download to your computer that requires activation using the Line 6 License Manager.

2.4      iLok License Order” means the license and delivery of one or more Software products in a single transaction delivered by internet download that requires the deposit of an iLok License into an iLok hardware device to authenticate the software.

2.5      Receipt” means the email confirmation sent to you confirming our acceptance of your order and dispatch of the Software.

2.6      Software” means a downloadable software-only product that is licensed to you subject to the applicable end-user license agreement, delivered to your computer via the internet, and described in your order confirmation and receipt (each delivered by email to the email address provided by you to Line 6).

2.7      Website” means the website operated by Line 6 and located at the URL: www.line6.com.

2.8      Web Store” means the online store operated by Line 6 located at the URL: shop.line6.com.

 

 

Order Process

3.1           Upon placing an order for Software (whether a Line 6 License Order or an iLok License Order), you will receive (A) an onscreen confirmation, which we suggest you print for your records, and (B) a Receipt via e-mail acknowledging the order and providing activation instructions. 

 

 

Prices

4.1      Prices offered on the Web Store are in U.S. dollars.  Foreign currency may be displayed for informational purposes only. The price paid as reflected on your Receipt is in U.S. dollars.

4.2      Prices do not include sales tax, if applicable, which will be added to your total invoice price and provided to you both before you place your order and in your order confirmation. You are responsible for any federal, state and local taxes that may apply to your order.

4.3      Prices and configurations advertised on the Web Store are subject to change without notice or obligation prior to acceptance of your order.  We take reasonable care to ensure the prices are correct.  If we discover a pricing error, we will notify you at the email address provided by you.  Changes to pricing will not affect any order which we have confirmed with a Purchase Receipt.

4.4      The final, total price, including any applicable taxes, will be stated on your Receipt.

 

 

Delivery

6.1      Licenses and delivery of Software can be completed using the Line 6 License Order or iLok License Order.

6.2      Line 6 License Orders are delivered by internet download to your computer, and require activation of the Software using only Line 6’s License Manager utility tool.  You will receive one (1) license per order that can be managed in your Line 6 user account’s “Purchase History” page.

6.3      iLok License Orders are delivered by internet download into an iLok hardware device via your computer.  To facilitate delivery, the iLok License is delivered to your Line 6 user account.  From your Line 6 user account you can download the iLok License into an iLok hardware device using your computer.  You will receive one (1) iLok Deposit License per Software product purchased.  You can activate and manage your iLok licenses on the iLok Deposits page [www.ilok.com/ilm].

 

 

Payment

7.1      You can pay for Software licenses using a debit card, credit card or gift cards featuring the Visa®, Master Card® or American Express® logos.  You can also pay for Products using PayPal.  For help setting up or accessing your PayPal account, contact PayPal.  Checks are not accepted.

7.2      We will not charge your card or account until the Software is available for download.

 

 

Return Policy

8.1      We will not accept the return of any Software that you purchased from a third party.

8.2      Line 6 License Order

8.2.a.     You may return Line 6 License Orders of Software at any time during the first fourteen (14) days following the date of your license for a full refund subject to the conditions set forth in this Section 8.2.  After this fourteen (14) day period, returns will not be accepted and no refund will be paid.

8.2.b.     All Software licensed in a single transaction must be returned together.  A refund for less than the full original order amount cannot be issued.

8.2.c.     To return a Line 6 License Order please follow these steps: 

A.     De-authorize all of your devices using the License Manager utility program.

B.     Log into your Line 6 User Account.

C.     Go to the ‘Purchase History’ page and click on the ‘Details’ link.  Find the order you want to return and make a note of the order number to be returned.  Open a ticket at www.line6.com/support/itckets and include the order number to be returned.

D.    Re-authorize all of your devices using the License Manager utility program. 

8.3      iLok License Order.  We cannot accept returns of any iLok License order because the iLok License is managed by a third party (iLok).

 

 

Limited Warranty; Disclaimer of Warranties

9.1      All Software is sold ‘as is’ without warranty of any kind. 

 

 

Governing Law; Disputes

10.1   You agree that all matters relating to your access to or use of the Website and Web Store, including all disputes, will be governed by the laws of the United States and by the laws of the State of California without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by and venue in the state and federal courts in Los Angeles County, California, and waive any objection to such jurisdiction or venue.  Any claim under these Terms must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. No recovery may be sought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and attorneys’ fees.  In the event of any controversy or dispute between you and Line 6 arising out of or in connection with your use of the Web Store, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within thirty (30) days, then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.

Helix Native Promotional Savings

Terms and Conditions

 

Qualified Purchasers can receive Promotional Savings on a Helix Native license when they purchase and register an Eligible Product according to the terms and conditions of this offer.

 

Qualified Purchasers: A “Qualified Purchaser” is an individual who purchases (or has purchased) an Eligible Product from an Authorized Reseller and registers (or has registered) the Eligible Product with Line 6 at www.line6.com/support/account-services.  

  • Registration of the Eligible Product is required for a Qualified Purchaser to demonstrate that he or she qualifies for the Promotional Savings.
  • Public entities, government entities, nonprofit organizations, educational institutions, enterprise purchasers and business purchasers do not qualify and Line 6 reserves the right to cancel purchases made by such purchasers. 

 

Eligible Products:  “Eligible Products” include Helix® Floor, Helix® Rack, Helix® LT, POD® X3 (all models), POD Farm® Platinum, POD Farm® Standard, POD Studio® (all models), Tone Port™ UX8, Tone Port™ Silver bundle, and Tone Port™ Gold bundle only. The following purchase restrictions apply to this Offer:

  • Eligible Products must be purchased as new from an authorized Line 6 reseller (an “Authorized Reseller”). 
  • Purchases of Eligible Products from online auctions are not eligible for this Offer.
  • Eligible Products do not include refurbished products, “b-stock” items, open box items or returns sold “as is”, or other non-new products. 
  • Eligible Products must be owned by the Qualified Purchaser for a period of no less than one hundred eighty (180) days in order to qualify for the Promotional Savings.

 

Promotional Product: The “Promotional Product” is the Helix® Native audio plug-in.

 

Promotional Savings: The “Promotional Savings” is the discount received by the Qualified Purchaser for each combination of Eligible Product and Promotional Product purchased as listed below.  You will not receive the Promotional Savings if the serial number of the Eligible Product has already been registered with Line 6 by another end-user.

The Offer:  Qualified Purchasers who purchase (or have purchased) and register (or have registered) an Eligible Product may receive the applicable Promotional Savings on the purchase of a Promotional Product.  The Promotional Savings will be reflected in the final purchase price at the time of purchase of the Promotional Product. The Promotional Savings is not a “gift”.  This offer expires when the purchase of the Promotional Product is complete. Limit one (1) Promotional Product per qualifying Eligible Product purchase and registration. A Line 6 Account (see www.line6.com/support/account-services) and an internet connection is required to purchase and activate a Promotional Product pursuant to this Offer.  Line 6 reserves the right to conduct random audits of all Line 6 Accounts, Eligible Product registrations and Promotional Product licenses in order to ensure compliance with the terms and conditions of this Offer.  If Line 6 determines, in its sole discretion, that you participated in this Offer but were not a Qualified Purchaser, you are solely responsible for paying Line 6 the Promotional Savings or returning your Promotional Product for a refund of the amount originally paid.

 

Eligible Product Returns, Exchanges, and Third Party Sales:  Returns and exchanges of Eligible Products are subject to the policy of the Authorized Reseller from which the original purchase was made. 

  • If an Eligible Product is returned to the Authorized Reseller or exchanged for a non-eligible product within one hundred eighty (180) days of the purchase of the Promotional Product,
    • the Promotional Savings may be deducted from the amount of the return or exchange, as applicable, and any remaining difference charged to the Qualified Purchaser; or
    • the license for the Promotional Product may be revoked until the Qualified Purchaser complies with all of the terms and conditions of this Offer or the Qualified Purchaser pays the full retail price for the Promotional Product.
    • If an Eligible Product is sold by the Qualified Purchaser to a third party within one hundred eighty (180) days from the date of purchase from the Authorized Reseller,
      • the license for the Promotional Product may be revoked until the Qualified Purchaser complies with all of the terms and conditions of this Offer or the Qualified Purchaser pays the full retail price for the Promotional Product.
      • If an Eligible Product is exchanged for another Eligible Product where the Promotional Savings is less than originally received by the Qualified Purchaser,
        • the difference in the eligible Promotional Savings may be charged to the Qualified Purchaser; or
        • the license for the Promotional Product may be revoked until the Qualified Purchaser complies with all of the terms and conditions of this Offer or the Qualified Purchaser pays the full retail price for the Promotional Product.

 

Promotional Product Returns: The Promotional Product may be returned to the Authorized Reseller or Line 6, as applicable, for a full refund within thirty (30) days of the date of purchase.

 

Offer Restrictions:  This Offer is limited to Eligible Products in-stock and available only while supplies last. Applicable tax, if any, is the sole responsibility of the Qualified Purchaser.  Line 6 does not allow product substitutions, deletions, additions or other modifications to this offer, regardless of information you learn from other sources.  Line 6 is not responsible for misinformation about this Offer that you may have received from other sources. Void where prohibited, taxed or restricted by law.  Line 6 may end this Offer at any time, for any reason. Line 6 is not responsible for any loss, destruction or theft of your Eligible Product or Promotional Product.  In order to determine that you are a Qualified Purchaser, Line 6 may receive personal information about you from the applicable Authorized Reseller from which you purchased your Eligible Product and/or the Promotional Product.  Line 6 may use any information provided by you or an Authorized Reseller about you in accordance with its privacy policies posted online at www.line6.com/privacypolicy.    Line 6 reserves the right to change without notice the Terms and Conditions of this Offer or to modify or end this Offer at any time without notice.
